Here’s my story. I was working in VA where I signed a contract that states unlimited PTO and being a small company, had no 2 weeks notice policy. I helped build this lab up from scratch and was told (not on paper) that I would be included in all future business decisions. This was not the case and the business was being sold to an out of state lab just as I left for another company. I gave my two weeks notice that would have me working through March 9th of 2022. I have a recurring stomach issue and of course I end up in the hospital March 2, 2022, due to non stop vomiting. These incidents last for weeks and I was not able to return to my job before my new one started. I got paid in mid March with a paycheck that went through March 2nd and have confirmed that medical insurance was taken out of that final paycheck. I believe I should have also gotten another paycheck through the 9th since I had unlimited PTO but wasn’t about to press it.

Initially insurance covered my expenses for March 2, 2022, up until this past December 2022 when they took the money back. I am now responsible for over 8k in bills because they say I wasn’t covered and that my old boss told them my coverage ended in February. I read that even if you work into a month, companies can cancel insurance policies at the beginning of said month. But what about the fact that they took my money for the insurance in March? I feel like at the very least I should get that money back but I’m hoping I have grounds to sue. They never offered me cobra or told me my insurance was being cut off. In fact I was told I’d have it through April but I unfortunately don’t have that in writing.

Does anyone think I have a case?

If not it’ll got to collections because I’m already paying down $4k in medical bills and have no money left for this one.
