ER Treated The Wrong Patient As Me And Gave This Stranger Information About Me

I went to the ER a couple of night ago while I was experiencing the worst pain in my life. The ER was unorganized and I didn’t have confidence in the staff there so at about 6 AM I left and went home. I knew that my doctor’s office would open at 7:30 and that she’d see me that day. I have a high deductible policy and was freaking out about my potential financial ruin.

I started getting text alerts about my prescriptions from the visit and when I looked at my chart online a doctor had prescribed muscle relaxers and opioid medications to me after a visit I never had.

I later found out that the hospital treated someone else as me and gave this person discharge paperwork that has my personal information including health info on it and they also put the info from this random person’s exam with the doctor in my chart.

How do I get ahead of this administrative nightmare with my insurance company? I don’t want to pay for services I didn’t receive. And is there any way that I can hold the hospital accountable for this HIPAA violation? Thanks!
