Ex Husband Can’t Keep Steady Insurance

I have a situation, I'm in the state of Texas. My kids father was required in the divorce to carry health insurance on the kids. It took him years to do this and he finally added them them this last fall. So I took them off what they were on.

Well I found out he no longer has a job thus no insurance. I really need my kids to be covered. I'm engaged to be married and I was added to my soon to be husband's insurance in the fall because the kids were going to be on their fathers insurance. If we go ahead and get married we could add the kids to their soon to be step dads plan.

Would this be a legal issue because of the divorce paperwork saying Dad needs to provide insurance?

If he then out of spite the next time he gets a job and qualifies for insurance and puts them on his would it be a legal issue?

Dad is just not steady in employment and it would be a better choice to just keep them on step dads plan overall, and it's good insurance.

What are my options?
