If a person reaches their OOPM on a claim, but the medical facility gives them a discount on the amount due, can the person’s insurance company change any EOB’s that came after that claim that were $0 cost share until the person reaches the OOPM from the discounted amount paid?

Let’s say you have an out of pocket maximum of $4000. You go to the hospital in beginning of year, and the bill/EOB comes back as $5000, so you’ve reached your oopm and all other in network bills after are $0 cost share. Let’s say in the middle of the year, you negotiate the hospital bill down to $2000 and pay the $2000

If your insurance finds out, can they change the previous claims before that that came back as $0 cost share (because they thought you had met the oopm with the $5000 bill) to the cost share of whatever was billed and would have been charged if you hadn’t met your oopm until you reach rest of the $4000. If not, can they do the same with any claims coming in after you pay the $2000 until you get to your oopm?

Just in case I wrote this too confusingly to understand, I thought I’d do a tldr:

Oopm is $4000

In January go to hospital, eob says you have to pay $5000

You have claims for February March and April after that that say $0 cost share because you’ve reached the oopm

In June, you negotiate with hospital to pay $1000. Insurance finds out

Can insurance change eob of claims from feb March and April for whatever the cost share would have been if you hadn’t reached your oopm, until you reach the oopm.

If not, can they do this with any claims going forward from june until you reach your oopm
