Quitting Job for Insurance Qualifying Event?

Question: If I leave my job and potentially get rehired at the same company, is that still a qualifying life event for me to join my husband’s health insurance plan.

I know it sounds kind of crazy, but hear me out. My husband and I are both currently employed and both have insurance through our respective employers. His happens to be much better than mine and for individual and family plans they are pretty comparable price-wise, but his doesn’t offer an employee + spouse option, just an employee + family option, so for just the 2 of us it ends up being quite a bit more expensive, so I haven’t been on his plan due to that.

I’ve been dealing with knee issues since May 2021 and finally found a doctor who thinks they know what the issue is and is very familiar with the surgery to treat it. That was scheduled for last Friday until 3 days before when I found out insurance denied it because its “not medically necessary” and the hospital wants 32K to do it patient pay. At this point I’m at my wits end trying to figure out what to do since according to the denial it doesn’t seem like there’s any wiggle room in the insurance (BCBS MN)/evicore’s criteria, and while we can redo the measurements, they also require imaging to show the issue (which doesn’t appear on imaging… plus they denied a request for an updated MRI as well). Plus my company is moving to Cigna Jan 1, which uses the same criteria but puts us back at square one for all the insurance mess.

To get around this and be able to get my surgery before more permanent damage is done, I’m trying to figure out ways to get on my husbands plan, since they are very easy to work with, both as a patient and the drs have said the same thing for their side. Unfortunately, while most open enrollments are now, his plan term starts July 1, and I can’t really wait that long.

My bosses have been very understanding and have offered to have HR try to help talk to BCBS, but it doesn’t seem like that would do anything. So instead I might see if there’s a way we can use the loss of coverage life event to have me join my husbands plan. If it’s legal I think the company might be willing to help/rehire me if I quit to join his insurance, but I wanted to see if that’s even legal.
